Surrogacy question.......?

The recent announcement that Nicole Kidman and Keith Urban hired a surrogate to carry their biological child has me wondering: does Nicole have to adopt the baby in this instance? The child is supposedly biologically hers, but she did not give birth. Does the hospital allow the bio mom to sign the birth certificate even though someone else gave birth to the child? I'm confused.
